LEASE LIAISON TERMS OF SERVICE FOR LANDLORDS
Please read these terms carefully before using our website or services.
1. Acceptance of Terms
By accessing or using the Lease Liaison website or services, all users — including landlords, tenants, and agents — agree to be bound by these Terms of Service. Lease Liaison is owned and operated by Amber Dregalla, licensed Realtor with Keller Williams Premier, Colorado.
2. Scope of Services
Lease Liaison provides tenant placement and marketing services only. We are not a property management company and do not manage or oversee ongoing tenancy.
All affiliated agents are independently licensed and insured through their respective brokerages. Lease Liaison’s role is limited to marketing, screening, showings, and lease facilitation.
3. Tenant Applications
- Applications are collected securely through encrypted third-party platforms.
- Applicants receive a copy of their completed application upon submission.
- Applications and sensitive data are automatically deleted within 30 days, in accordance with C.R.S. § 6-1-713 (Colorado Consumer Protection Act).
- Lease Liaison does not sell, share, or distribute private tenant data except for the purpose of lawful screening and verification.
4. Tenant Deposits
- All applicants agree to pay a $500.00 non-refundable deposit to begin processing.
- This deposit covers administrative, screening, and coordination costs and is not refundable under any circumstance, including withdrawal, denial, or cancellation.
- Payment of this deposit signifies acceptance of all terms herein.
5. Agent Selection and Representation
- Tenants and landlords may choose their preferred licensed agent.
- Lease Liaison reserves the right to reassign agents at any time for scheduling, compliance, or service quality reasons.
- All agents act as independent contractors under their brokerage and are not employees of Lease Liaison.
6. Lead Ownership
- All tenant and landlord inquiries originating through Lease Liaison’s website, advertisements, or partner channels remain the exclusive property of Lease Liaison.
- Lease Liaison retains the right to use lead data for future marketing, education, or business development, in compliance with privacy laws.
- If a landlord later hires a Lease Liaison-affiliated agent independently, a 20% referral fee is due to Amber Dregalla, owner of Lease Liaison.
7. Landlord Responsibilities and Liability
- Landlords who select the Secure Showing Package acknowledge they are fully responsible for property condition, damages, or liability if showings occur without a Lease Liaison agent present.
- Lease Liaison, its owner, and affiliates are released from all liability once a tenant has been placed.
- Landlords retain full discretion in tenant approval and assume all risks related to rent collection, maintenance, damages, disputes, and tenant behavior.
- Lease Liaison provides no guarantee or warranty on tenant performance, lease compliance, or payment of rent.
8. Renewals and Ongoing Tenancy
- Landlords may renew leases directly with tenants outside of Lease Liaison at no additional charge.
- Lease Liaison is not involved in rent collection, renewals, or dispute resolution after placement.
9. Subscription and Vendor Access
- Landlords agree to maintain an active subscription for access to Lease Liaison’s vendor directory, legal resources, and dashboard tools.
- All vendors are independent contractors; Lease Liaison assumes no responsibility or liability for vendor work, pricing, or outcomes.
10. Exclusivity and Non-Solicitation
- Landlords agree not to hire or subcontract any Lease Liaison-affiliated agent for rental services outside the platform.
- Any direct hiring initiated outside the platform triggers a 20% referral fee to Lease Liaison.
11. Agent Termination and Replacement
- Landlords may terminate their agent at any time.
- The $500 deposit remains non-refundable, but Lease Liaison will assign a replacement agent at no additional charge upon request.
12. Limitation of Liability
To the fullest extent permitted by law:
- Lease Liaison, its owner, affiliates, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from tenancy, screening results, showings, property access, or lease execution.
- Users agree to indemnify and hold harmless Lease Liaison and Amber Dregalla from any claims, damages, or disputes arising after tenant placement or outside the direct scope of contracted services.
- Lease Liaison provides all materials and services “as is” without warranty of any kind.
13. Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Colorado. Any disputes shall be resolved exclusively in El Paso County, Colorado, through binding arbitration or mediation prior to litigation.
